Applicability of The Agreement                                         

This agreement ("user agreement") contains the terms and conditions under which DiscoverYourTrails will provide services to the person (s) ("the User") who intends to purchase or inquire about any of DiscoverYourTrails products and/or services by using DiscoverYourTrails websites or any other DiscoverYourTrails customer interface channels, such as its salespeople, offices, call centers, advertisements, information campaigns, and so on. Individually, User and DiscoverYourTrails are referred to as "parties" to the agreement, and together as "parties."

User's Responsibility of Cognizance

Users who use DiscoverYourTrails services are presumed to have read, understood, and expressly accepted the terms and conditions of this agreement, which regulate the intended transaction or supply of such services by DiscoverYourTrails for all reasons and are enforceable against the User. All of the User's and DiscoverYourTrails rights and obligations in relation to any DiscoverYourTrails services will be limited to the scope of this agreement.

DiscoverYourTrails maintains the right, in its sole discretion, to suspend or terminate access to any or all TLG websites, other sales channels, and associated services, or any portion thereof, at any time, without notice, for any reason.

In addition to this Agreement, there are some terms of service (TOS) that apply to DiscoverYourTrails services and goods, such as flight tickets and vacation packages. DiscoverYourTrails will provide/update such TOS, which will be considered a part of this Agreement, and in the case of a discrepancy between such TOS and this Agreement, the provisions of this Agreement will take precedence. The User must read and accept the applicable TOS for the service/product that they have purchased. Furthermore, the Service Provider may provide its own terms and guidelines that govern certain features, offers, or the operational norms and standards that apply to each Service. The User is responsible for adhering to the terms and guidelines, as well as the operating rules and policies of the Service Provider with whom the User chooses to do business, including the terms and conditions outlined in the Service Provider's fare regulations, contract of carriage, or other restrictions.

DiscoverYourTrails Services are provided to the User on the premise that the User accepts all of the terms, conditions, and notifications included in this Agreement and the TOS, as amended from time to time. For the avoidance of ambiguity, it is specified that the User's use of the Services implies an awareness and acceptance of this Agreement and the TOS by the User. If the User does not agree with any portion of these terms, conditions, or notifications, he or she should not use DiscoverYourTrails services.

If any of the terms, conditions, or notices in this document conflict with the Additional Terms or any terms and guidelines in any other DiscoverYourTrails document, these terms will take precedence.

Third Party Account Information

By utilising DiscoverYourTrails Account Visit service, the User permits DiscoverYourTrails and its agents to access third-party sites, such as those of banks and other payment gateways, that they have designated or that DiscoverYourTrails has access to on their behalf in order to retrieve required information. The User will select a password upon registration and is responsible for keeping the password and account secure.

All acts that occur while using their password or account are solely the responsibility of the User. Any unauthorised use of the User's password or account, or any other breach of security, must be reported to DiscoverYourTrails promptly in writing. DiscoverYourTrails will not be accountable to the User for any losses caused as a consequence of illegal use of his password or account, whether with or without his knowledge. At no point should the User use anybody else's password.

Confidentiality

Any information designated as confidential by DiscoverYourTrails must be kept confidential by the user and will not be divulged unless necessary by law or to fulfil the purposes of this agreement and the duties of both parties thereto.

Website Usage

Any information or resources on the website are used at your own risk, and DiscoverYourTrails has no responsibility for them. You are solely responsible for ensuring that any items, services, or information made available through our website or app fulfil your specified requirements.

Any information, software, goods, or services obtained through this website or app may not be altered, duplicated, distributed, transmitted, reproduced, published, licenced, or sold. Duplication of content from the website and app is prohibited, as stated in the copyright notice, which is part of the Terms of Service.

DiscoverYourTrails also maintains the right to edit, update, and delete any of the materials at any time without previous notification to anybody.

Usage Of The Mobile Number Of The User By DiscoverYourTrails

DiscoverYourTrails may send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change, or any other transaction-related information to the User's phone number provided at the time of booking; DiscoverYourTrails may also contact the User by phone, SMS, or email if the User could not or has not completed the booking for any reason, to learn the User's preference for completing the booking. The User hereby unconditionally consents that such communications by DiscoverYourTrails via SMS and/or voice call are (a) made at the User's request and authorization, (b) "transactional" and not "unsolicited commercial communication" as defined by the Telecom Regulation Authority of India (TRAI) guidelines, and (c) in accordance with the relevant guidelines of TRAI or such other authority in India and abroad. DiscoverYourTrails will be indemnified against all losses and damages incurred by DiscoverYourTrails as a result of any action taken by TRAI, Access Providers (as per TRAI regulations), or any other authority as a result of any erroneous complaint raised by the User on DiscoverYourTrails with respect to the intimations mentioned above, or as a result of the User providing a wrong number or email id for any reason.

Onus Of The User

DiscoverYourTrails is exclusively liable for the transactions that the User conducts via DiscoverYourTrails. DiscoverYourTrails is not responsible for transaction screening, censorship, or other controls, including whether the transaction is lawful and valid under the laws of the User's home country.

The user must double-check the correctness of the data and bookings. In connection with the use of the services, the user declares that they will follow any extra processes and guidelines, as changed from time to time. The User further guarantees that they will follow all applicable rules and regulations when using the services in the country in question for each transaction.

Insurance?

Obtaining adequate insurance coverage is the user's responsibility/option unless specifically supplied by DiscoverYourTrails in any specific service or deliverable, and DiscoverYourTrails does not accept any claims stemming from such instances.

DiscoverYourTrails insurance, if supplied as part of a service/product, will be subject to the insuring company's terms and conditions. For any claims or disputes, the User must contact the insurance provider directly, and DiscoverYourTrails makes no express or implied guarantees that the insurance company will accept the claims.

Force Majure Circumstances

The user acknowledges that there may be exceptional circumstances in which service providers, such as airlines, hotels, and other transportation providers or concerns, are unable to honour confirmed bookings due to a variety of factors, including weather, labour unrest, insolvency, business exigencies, government decisions, operational and technical issues, route and flight cancellations, and so on. DiscoverYourTrails will do its best efforts to provide equivalent alternatives to its customers or reimburse the booking money after reasonable service costs, if supported and refunded by the individual service operators, if TLG is advised in advance of such scenarios where dishonour of bookings may occur.

DiscoverYourTrails, as an agent for facilitating booking services, accepts that it is not liable for any such occurrences, and that consumers must contact the service provider directly for any further resolutions or refunds.

The User acknowledges that, in the event of a technical or other failure on DiscoverYourTrails part, services previously committed may not be performed or may be substantially modified. In such situations, DiscoverYourTrails would reimburse the whole money received from the client for such services, less any applicable cancellation, refund, or other costs, thereby fully discharging DiscoverYourTrails from any and all liability for such non-provision of services or faults. If there are any additional obligations, they will be met by the User.

DiscoverYourTrails will not be liable for any delays or inability to perform or nonperformance of its obligations in whole or in part due to causes beyond its reasonable control, such as acts of God, fire, strikes, embargoes, acts of government, acts of terrorism, or other similar causes, or problems at the end of airlines, rails, buses, hotels, or transporters. In this case, the impacted user will be notified as soon as the situation allows.

Without limiting the above, DiscoverYourTrails maximum responsibility in respect of any services supplied on the site, under all circumstances, shall be limited to a refund of the whole amount received from the customer for the services, less any cancellation, refund, or other costs, as may be applicable. In no event may DiscoverYourTrails liability extend beyond the amount charged by DiscoverYourTrails for its services for any loss, damage, or additional expenditure. DiscoverYourTrails and/or its suppliers will not be liable for any direct, indirect, punitive, incidental, special, consequential, or any other damages arising out of or in any way connected with the use or performance of the DiscoverYourTrails website(s) or any other channel, including, without limitation, damages for loss of use, data, or profits. DiscoverYourTrails will not be liable for any delay or inability to use the DiscoverYourTrails websites or related services, or for any information, software, products, services, and related graphics obtained through the DiscoverYourTrails website(s), or otherwise arising out of the use of the DiscoverYourTrails website(s), whether based on contract, tort, negligence, strict liability, or otherwise. DiscoverYourTrails disclaims any and all liability for any mistakes, omissions, or statements on any of its pages, links, or connected website pages.

Safety Of Data Downloaded

The User acknowledges and accepts that any material and/or data downloaded or otherwise acquired through the use of the Service is done fully at their own risk, and that they will be solely responsible for any damage to their computer systems or loss of data that comes from such download.

DiscoverYourTrails shall, however, make every effort to guarantee that the material on its websites and other information channels is free of viruses and other malware.

Feedback from Customer and Solicitation offers a variety of services such as hotel reservations, vehicle rentals, and vacations, and would like to learn more about them in order to improve his or her travel experience. The User expressly permits DiscoverYourTrails to contact the User from time to time with offers on various DiscoverYourTrails services by direct mailers, e-mailers, phone calls, short messaging services (SMS), or any other media. If the consumer prefers not to be contacted, he or she should write to DiscoverYourTrails for particular exclusion at Info@discoveryourtrails.com or inform the service provider of his or her choices. Customers should read and understand DiscoverYourTrails privacy policy on its website, which governs how DiscoverYourTrails contacts, solicits, and discloses the information of its customers.

Proprietary Rights

DiscoverYourTrails may offer the User with content from sponsor advertising or information, such as sound, photos, graphics, video, or other media. Copyrights, trademarks, and other intellectual property rights and laws may apply to this material.

The User may only use this content in the ways that DiscoverYourTrails has specifically approved, and may not reproduce, transfer, or create derivative works of it without DiscoverYourTrails written permission.

The User recognises and agrees that he or she will not upload, post, reproduce, or distribute any content on or via the Services that is protected by copyright or other property rights of a third party without first getting the owner's prior consent

Any copyrighted or other proprietary work that is disseminated with the owner's permission must include a copyright or other proprietary rights notice. Unauthorized posting or distribution of copyrighted or other proprietary content is prohibited and may result in personal responsibility or criminal prosecution for the User.

Visa Obligations of the User

DiscoverYourTrails travel arrangements are subject to the appropriate Visa requirements, which must be met by the individual traveller. DiscoverYourTrails is not accountable for any complications stemming from such Visa requirements, including incapacity to travel, and is also not obliged to refund for any untraveled reservations owing to such reasons.

Indemnification

DiscoverYourTrails and/or its affiliates, their websites, and their respective lawful successors and assigns agree to indemnify, defend, and hold harmless DiscoverYourTrails and/or its affiliates, partner websites, and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs, and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by DiscoverYourTrails and/or its affiliates, partner websites

Any violation of any country-specific rules and regulations or general code of conduct will be totally and exclusively the responsibility of the user, and DiscoverYourTrails will not be held accountable.

Right To Refuseot complete until the client has paid in full for the service and DiscoverYourTrails has accepted it.

DiscoverYourTrails may limit the user's activity, or end the user's listing, warn other users of the user's actions, immediately temporarily/indefinitely suspend or terminate the user's registration, and/or refuse to provide the user with access to the website, without prejudice to any other remedies available to DiscoverYourTrails under this agreement, the TOS, or applicable law if:

The user violates this agreement, the TOS, and/or the documents it incorporates by reference.

DiscoverYourTrails is unable to validate or authenticate any of the user's information; or

DiscoverYourTrails thinks that the user's conduct may infringe on third-party rights, violate any relevant legislation, or otherwise expose the user, other website users, and/or DiscoverYourTrails to responsibility.

DiscoverYourTrails reserves the right to restore suspended users at any moment. Once a user has been indefinitely suspended, the user must not register with DiscoverYourTrails or attempt to register with DiscoverYourTrails, nor use the website in any way until DiscoverYourTrails reinstates the user.

Regardless of the above, if the user violates this agreement, the TOS, or the documents it includes by reference, DiscoverYourTrails retains the right to collect any money owed to DiscoverYourTrails and/or the service provider, as well as to take any other legal action DiscoverYourTrails considers appropriate.

Right To Cancellation In Case Of Invalid User Information

When requesting any services under this agreement, the User expressly agrees to supply only true and legitimate information to DiscoverYourTrails, and not to make any false statements about facts. Any default on the part of the User will void this agreement and prevent the User from using DiscoverYourTrails services.

If DiscoverYourTrails discovers or has reason to believe at any time during or after receiving a request for services from the User that the request is either unauthorised or that the information provided by the User or any of them is not correct or that any fact has been misrepresented by him, DiscoverYourTrails shall have the unrestricted right, in its sole discretion, to take any action against the User(s), including cancellation of bookings, etc. without prior notice to the User(s). In this case, DiscoverYourTrails will not be responsible or liable for any loss or damage that the User or any of them may suffer as a result of the cancellation of the booking or services.

The User unconditionally releases DiscoverYourTrails from any such claim or obligation, and agrees not to hold DiscoverYourTrails liable for any loss or harm resulting from DiscoverYourTrails efforts to protect its own interests and those of its legitimate customers. This includes DiscoverYourTrails refusing or cancelling any bookings based on suspected fraud transactions.

Severability

If any provision of this agreement is found to be invalid or unenforceable in whole or in part, the invalidity or unenforceability will apply only to that provision or part of that provision, and the remainder of that provision, as well as all other provisions of this Agreement, will remain in full force and effect.

Headings

The headings and subheadings in this document are for reference only and do not describe, interpret, define, or limit the scope, extent, or intent of this agreement, terms and conditions, notices, or the User's right to use this website contained herein, or any other section or page of DiscoverYourTrails Websites or its partner websites, or any provision hereof in any way.

If any of the terms, conditions, or notices stated herein conflict with the Additional Terms or other terms and guidelines found on any DiscoverYourTrails website, these terms will take precedence.

Relationship

None of the provisions of any agreement, terms and conditions, notices, or the User's right to use this website contained herein, or any other section or pages of DiscoverYourTrails Websites or its partner websites, shall be deemed to constitute a partnership between the User and DiscoverYourTrails, and neither party shall have any authority to bind the other in any way.

Updation Of The Information By DiscoverYourTrails

DiscoverYourTrails delivers services with appropriate effort and care, according to the user. It makes every effort to guarantee that the User is not inconvenienced. However, the information, software, goods, and services included in or available through DiscoverYourTrails websites or other sales channels and marketing materials may have inaccuracies or typographical mistakes from time to time, which will be updated as soon as DiscoverYourTrails becomes aware of them. Changes to the information supplied may be made/added on a regular basis. DiscoverYourTrails has the right to make enhancements and/or modifications to its websites at any time and without prior notification to the User. Any advice obtained other than from a DiscoverYourTrails authorised professional via the DiscoverYourTrails websites should not be used to make important choices.

Modification Of These Terms Of Use

DiscoverYourTrails maintains the right to modify the terms, conditions, and notifications that govern the use of the DiscoverYourTrails websites, including but not limited to the charges. The User is responsible for checking these terms and conditions on a regular basis.

Jurisdiction

?DiscoverYourTrails explicitly disclaims any implied guarantees imposed by the laws of any jurisdiction or nation other than those in which its offices are located. DiscoverYourTrails believes itself to be subject to the sole jurisdiction of the courts of Chennai or Delhi, India, and wants to remain so.

Responsibilities Of User Vis-a-Vis The Agreement

The User clearly acknowledges that usage of the services is entirely at their own risk. DiscoverYourTrails shall have no liability for any element of the service providers' standards of services to the extent that it operates simply as a booking agent on behalf of third-party service providers. DiscoverYourTrails will not be held accountable for the services supplied by the service provider under any circumstances. The services are made available "as is" and "as available." DiscoverYourTrails has the right to alter the features or functioning of the services at any time and without notice. DiscoverYourTrails explicitly disclaims any warranties, express or implicit, of any kind, including but not limited to implied warranties of merchantability, fitness for a specific purpose, and non-infringement. Any advice or information obtained by the User from DiscoverYourTrails or through the services, whether oral or written, will not create any guarantee not expressly stated herein or in the terms and conditions of the services. If the User does not agree to any of the conditions listed above, they should not read the material on any of DiscoverYourTrails sites or use any of DiscoverYourTrails contents, pages, information, or other materials. The User's sole and exclusive recourse in the event of disagreement with the user agreement, in whole or in part, is to stop using the services after notifying DiscoverYourTrails in writing.
